MEWA EV Charger Application - Terms and Conditions

At the Ministry of Electricity and Water Affairs of the Kingdom of Bahrain (“MEWA”, “we”, “us”, or “our”), we are committed to protecting your privacy and ensuring the security of your personal information. This privacy policy (“Privacy Policy”) outlines how we collect, use, disclose, and safeguard your (“you” or “your”) data when you use our application for electric vehicle charging station services (“App”). By accessing, using, downloading or registering on our App in accordance with any terms and conditions which govern such use (“Terms”), you agree to the terms in this Privacy Policy.

This Privacy Policy must be read together with the Terms and any other policy we publish on the App from time to time. If you do not agree to the provisions of this Privacy Policy, you should stop using the App immediately.

1. Collection of Personal Data

We act as a ‘Data Controller’ of your personal data under this Privacy Policy in accordance with the provisions of the Kingdom of Bahrain’s Law No. (30) of 2018 Promulgating the Personal Data Protection Law as amended from time to time (“Personal Data Protection Law”). For the purposes of this Privacy Policy, “Process” or “Processing” has the meaning given to that term under the Personal Data Protection Law.
We may collect and Process various types of information from you. This includes:
- personal information, such as your name, email, address, phone number, and personal identification or passport number which you provide when registering for an account on the App (“Account”);
- details of your bank account(s) and payment card;
- usage data, which includes information about how you interact with our App and electric vehicle charging stations (“Charging Stations”);
- profile data, including your Account username and password, your payment transaction history, your interests, preferences, feedback and survey responses;
- technical data, such as your device’s internet protocol address, the type of device, unique device identifiers, cookies, your login data, time zone setting and location and other technology on the devices you use to access our App;
- details of your electric vehicle, such as the vehicle make, model and registration number; and
- marketing and communications data, which includes your preferences in receiving communications and/or marketing material materials from us.
It is important that the personal data you provide us with is accurate and up to date. Please ensure to notify us of any changes to your personal data during your use of our App.
You may decide which information, if any, you would like to share with us. You understand that some functions of the App may be unavailable to you unless you provide us with the necessary information. Where we are required to collect personal data under applicable laws or the Terms and you fail to provide us with such data when requested, we may have to limit, cancel or suspend your use of the App.

2. How We Process Personal Data

We will Process your personal data in accordance with the laws of the Kingdom of Bahrain. You agree that we may Process your personal data where such Processing is necessary:
- for us to create and manage your Account;
- for billing purposes;
- for us to provide you with access to Charging Stations, process payments, and facilitate reservations;
- for our customer support team to respond to your inquiries and offer assistance;
- for us to analyse usage patterns to enhance the functionality and user experience of the App and Charging Stations;
- to send you updates, notifications and promotional materials related to our services;
- as a response to a request made by you pursuant to the Personal Data Protection Law;
- to protect your vital interests;
- to comply with our legal obligations under the laws of the Kingdom of Bahrain and with any order from a competent court or the Public Prosecution;
- where it is necessary for our legitimate interests (or those of a third party to whom your personal data is disclosed) without prejudice to your fundamental rights and freedoms; and
- to communicate with you about your use of the App and any changes to the App, the Terms, this Privacy Policy and/or other policies that may affect you.

3. Disclosure of Personal Data

You consent to the disclosure of your personal data for the following purposes:
- if required by applicable law or the order of any competent court; and/or
- to enforce, or review any breach of, the Terms, this Privacy Policy or any other policies that may affect you.
You consent to our disclosure of your personal data to:
- third party vendors or service providers who assist us in operating the App and Charging Stations and delivering our services;
- any relevant governmental or public authority;
- our accountants, auditors, financial advisors, lawyers and other external professional advisors; and/or
- any entity to whom the functions of MEWA are assigned to by law and/or any successor in title of the App.

4. Data Security

We take the security of your personal data seriously and have implemented appropriate security measures to protect your information from unauthorized access, use or disclosure in accordance with applicable laws. However, no method of transmission over the internet or electronic storage is completely secure. While we strive to protect your personal data, we cannot guarantee and shall not be liable for its security.

5. Amendments to this Policy

We may amend this Privacy Policy from time to time, therefore you are encouraged to revisit this Privacy Policy to review it. Such amendments will become effective and binding on you from the date of their publication on our App. Your continued use of the App and/or Charging Stations after such publication constitutes your acceptance of any amendments to this Privacy Policy.
